Historical development of institute of protection of the rights and freedoms of minors: the establishment of the legislation of the RSFSR
The article discusses the historical process of development of the legislation of the Russian Federation. The study and analysis of this aspect has been used in various scientific historical methods: problem — chronological method, historical Parallels, a retrospective, structural system, method of updating and method of historiographical analysis of the literature and the historical-legal method. On the basis of the conducted analysis the Author reveals the regularities of the historical development of the state in General and legislation in particular, gives a description of law enforcement in the Russian Federation. The study of the history of the development of the criminal process is of great importance, since it is a direct consequence of the centuries-old genesis of the law of Russia. Undoubtedly, the historical analysis of the development of criminal procedural legislation, including regulating the participation of a teacher in criminal proceedings, enriches historical and procedural science by identifying circumstances that served as the basis for changing and improving legislation in terms of guaranteeing the protection of the rights and legitimate interests of minors, and also contributed emergence of new options for legal regulation, regulating the participation of the teacher, which certainly helps appreciate the advantages and disadvantages of each option, as well as their continuity and appropriateness of borrowing historical experience. A significant and important event in the development of criminal procedural law is the reformation changes associated with the October Revolution of 1917. In connection with the adoption of the Constitution in 1918 and the formation of a completely new type of state, Soviet law is being formed, including the norms of the criminal procedural legislation regulating the participation of knowledgeable persons. The Code of Criminal Procedure of the RSFSR in 1922 and 1923. the participation of teachers in criminal proceedings, although not provided, teachers were still often involved in interrogation. Undoubtedly, the formation of the USSR contributed to the formation of a unified doctrine in the field of the process of proof, which directly affects the criminal process in cases of crimes committed by minors.
