Legislative regulation of the fight against terrorism in Israel: principles and new moments
The article analyzes the reasons for the adoption of the new law on combating terrorism, adopted in Israel in 2016. The author outlines the political and legal principles on which the fight against terrorism was built before the adoption of this law, and identifies the new norms that have been added in the sphere of combating terrorism as well as those having been preserved. The original Israeli legislation on combating terrorism was based on the norms of the British Mandate, which the country’s Supreme Court voluntarily tried to modernize. However, Israel was criticized from the point of view of human rights standards during anti-terrorist activities. The adoption of the new law is caused by the desire of the authorities of the country to clarify and streamline the existing norms, as well as to increase the accountability of the special services of executive power and civil society.
