GENESIS OF DOMESTIC LEGISLATION ON JUDICIAL CONTROL OF PRE-JUDICIAL PROCEEDINGS

The article reveals the establishment and improvement of the institution of domestic judicial control of pre-trial proceedings; The stages of its historical development are distinguished: the emergence of judicial control over pre-trial proceedings (early 60s of the XIX century), the development of the control powers of the courts in the process of judicial reform of 1864 (1864-1917), the reform of the system of judicial control powers (1917-1923 years), the abolition of judicial control at the pretrial stage (1923-1983), the revival of judicial control and the strengthening of judicial control powers (1983-2001), the expansion of judicial control at the pretrial stage (2001 — present) me); it is concluded that the abolition of judicial control at the pre-trial stage by the historical events of the Soviet period showed the negative significance of the absence of this institution in criminal proceedings, and its revival was the result of the idea of ​​an overdue change in the criminal process, its principles and forms in the direction of humanization and democracy.
